General Terms
1. Unlawful Use
You will agree to use the services provided by us for lawful purposes. Should your use of our services violates any law or regulations, we have the right to immediately withdraw our services to you and any money paid or work done will be forfeited.
2. Termination of Contract
If you at any time is in breach of the terms and conditions set out in this document, we reserve the right to terminate our services immediately and any money paid or work done will be forfeited.
3. Customer Details
It is your responsibility to notify us of any changes to your contact details so that the project can proceed smoothly. Failure do this may result in the termination of the contract.
4. Completion
We aim to complete the project within an agreed period or earlier (this will be agreed upon at the start of the project) provided that you supply the necessary information requested by us, within the specified time period. We will promise to meet the time frame agreed upon to our best ability.
Support
1. Coverage
We provide free support for websites and applications designed and developed by us. This excludes content changes and introduction of new functionality, which have to be agreed upon and paid for under a separate agreement.
2. Support Period
The support period is for the life of the websites and applications built by us. For hosting and domain name registration, the support period is limited to the service being active, that is, the registration is not lapsed due to failure to renew on the part of the customer.
Website Design and Development
1. Payments
We require 20% of the total cost to be paid before we commence work on your website design and development project. No refund shall be made by us to you for the money paid. We will do everything possible to meet your requirements within the mutually agreed time period for the design and development of your website. Full payment is required before your website is published to the internet.
2. Web Content
You are responsible to provide to us the content and any necessary photos for your website. Should you be unable to provide the content or photos within 2 working days from the time the request was made by us, we will provide blank pages for you to update later, using the content management system that the website is built upon. If you require us to update the content or photos for you later, we will charge an hourly fee.
We are able to source for relevant photos or graphics, should you require us to so, and this will be charged to your account.
3. Design Concept
We will first present to you our design concept(s). You will be given 3 working days to review it and provide your feedback. If you do not get back to us after 3 working days, your project will be suspended and no further work will be done on your website. Within 6 months from the date of the suspension of the project, we can resume working on your website provided you pay a penalty of A$100 + GST. We reserve the right to make changes to the cost of the remaining part of the project according to any updates to our charges since.
4. Revisions
You are entitled to a few rounds of revisions for your whole website and will be given 3 working days to return to us with any required amendments (that are within the scope of work specified in your contract) to both the design of, and the content on your website. Should there be no response regarding the work done so far, your project will be suspended and no further work will be done on your website. Within 6 months from the date of the suspension of the project, we can resume working on your website provided you pay a penalty of A$100 + GST. We reserve the right to make changes to the cost of the remaining part of the project according to any updates to our charges since.
5. Termination of Contract
Should you be unable to supply the necessary information requested within 2 working days or do not get back to us after the release of a design concept or revision (see above points) within 3 working days, we will suspend your project for up to 6 months, until you get back to us. After 6 months, we will terminate the contract and any money paid or work done will be forfeited.
6. Copyright
We reserve the right to hold the copyright for the source code used to design and develop your website or your software.
Software Application Development
1. Payments
A 20% deposit is required before the work begins. No refund shall be made by us to you for the money paid. We will do everything possible to meet your requirements within the mutually agreed time period for the design and develpment of the software application. Full payment is required before the software is released to you.
2. Termination of Contract
Should you be unable to supply the necessary information requested within 2 working days or do not get back to us after a revision within 3 working days, we will suspend your project for up to 6 months, until you get back to us. After 6 months, we will terminate the contract and any money paid or work done will be forfeited.
3. Copyright
We reserve the right to hold the copyright for the source code used to develop your software.
Website and Email Hosting
1. Payments
We require full payment for the website and email hosting fees before the website and email hosting begin. The renewal of the service is guaranteed by the full payment for the subsequent period.
2. Service Period
The website and email hosting we provide to you is for the agreed period. If the service period lapses without a renewal payment, the service will be suspended for a period of 1 month with all data intact. After the service period has lapsed for more than 1 month, we cannot guarantee the retention of the data on your website or email accounts. We will charge you for the work needed to reinstate your website or email accounts.
Logo Design
1. Payments
A 20% deposit is required before the work begins. No refund shall be made by us to you for the money paid. We will do everything possible to meet your requirements within the mutually agreed time period. Full payment is required before the final logo design is released to you via email.
If the logo is to be used for a website, to be designed and developed by PineMyrtle, the logo design has to be fully paid for before the work on the website commences.
2. Design Concept
We will first present to you a few design concepts. You will be given 3 working days to select the most suitable design for your business. If you do not get back to us after 3 working days, your project will be suspended and no further work will be done on your logo. Within 6 months from the date of the suspension of the project, we can resume working on your website provided you pay a penalty of A$50 + GST. We reserve the right to make changes to the cost of the remaining part of the project according to any updates to our charges since.
3. Revisions
You are entitled to a few rounds of revisions for your business logo and will be given 3 working days to return to us with any required amendments (that are within the scope of work specified in your contract) to the design. Should there be no response regarding the work done so far, your project will be suspended and no further work will be done on your logo. Within 6 months from the date of the suspension of the project, we can resume working on your logo provided you pay a penalty of A$50+GST. We may make changes to the cost of the remaining part of the project according to any updates to our charges since.
4. Termination of Contract
Should you be unable to supply the necessary information requested within 2 working days or do not get back to us after the release of a design concept or revision (see above points) within 3 working days, we will suspend your project for up to 6 months, until you get back to us. After 6 months, we will terminate the contract and any money paid or work done will be forfeited.
5. Copyright
You shall own the copyright to the logo design.
Domain Name Regisration
1. Payments
A 100% credit card payment is payable at the point of domain name registration.
2. Registration Period
Your domain name will expire after the registered period lapses. It is your responsibility to ensure renewal of your registration is done in a timely manner. Failure to do so may result in the domain name being taken by someone else.
